Welcome to CardClad. These Terms of Service (“Terms”) govern your use of the CardClad Shopify store (the “Site”) and any purchases. By accessing the Site or placing an order, you agree to these Terms, our Shipping Policy, and our Return & Refund Policy.

1. Overview

CardClad, LLC (doing business as CardClad) sells sports cards, Pokémon and other trading cards, graded cards, memorabilia, custom designs, and related collectibles. We operate from Wisconsin, United States.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase. By ordering, you represent that you meet this requirement.

3. Products & Descriptions

We strive for accurate descriptions, photos, and condition notes. Collectibles are unique; minor variations in centering, print, wear (as disclosed), or packaging can occur. Images are representative. Graded cards are sold as graded by the listed company. We guarantee authenticity of items sold as authentic to the best of our knowledge and sourcing.

Market values fluctuate; we are not responsible for changes in secondary-market value after purchase.

4. Pricing, Payment & Orders

Prices are listed in USD and may change without notice. Payment is due at checkout. We reserve the right to refuse or cancel any order (e.g., pricing errors, suspected fraud, inventory issues). You will be notified and refunded if cancelled after payment.

5. Shipping & Risk of Loss

Title and risk of loss pass to you upon delivery to the carrier. See our Shipping Policy for details.

6. Returns & Refunds

All returns and refunds, including any applicable restocking fees, are governed exclusively by our Return and Refund Policy.

7. Intellectual Property

All content on the Site (text, images, logos, custom card designs, branding, “CardClad,” taglines, and related materials) is owned by or licensed to CardClad, LLC. You may not copy, reproduce, sell, or create derivative works without prior written permission. Custom designs remain the intellectual property of CardClad, LLC.

8. Prohibited Uses

You may not use the Site for any unlawful purpose, to commit fraud, to reverse-engineer systems, to scrape data, or to interfere with the store’s operation.

9. Disclaimer of Warranties

Products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose, except as expressly stated regarding authenticity and the return policy.

10. Limitation of Liability

To the maximum extent permitted by law, CardClad, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Site or products. Our total liability for any claim shall not exceed the amount you paid for the specific product(s) giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless CardClad, LLC from any claims, losses, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the Site/products.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Wisconsin. You consent to personal jurisdiction there.

13. Changes

We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance. The “Last updated” date will be revised.
